SMS Terms and Conditions

1. About the LegacyCloud SMS Program

LegacyCloud, a service of Hustle Machine LLC ("LegacyCloud," "we," "us," or "our"), uses SMS (text messaging) to deliver short audio and video recording requests on behalf of LegacyCloud users.

A LegacyCloud user (a "Sender") enters the mobile phone number of a family member or other individual (a "Recipient") and confirms they have permission to contact that person. LegacyCloud then sends the Recipient an SMS asking whether they would like to receive a secure link to record a memory for the Sender.

2. How Consent Works

LegacyCloud uses a two-step (double opt-in) SMS flow for every Recipient:

1. After the Sender submits a request, LegacyCloud sends the Recipient a one-time consent request SMS that identifies LegacyCloud and the Sender, describes the request, and asks the Recipient to reply YES.
2. LegacyCloud sends no further SMS to the Recipient unless and until the Recipient replies YES from the number that received the consent message.
3. After receiving YES, LegacyCloud sends a link-delivery SMS containing a secure, single-use link to record the memory.

The Recipient's YES reply, the timestamp, and the originating phone number are logged as the Recipient's affirmative consent.

3. Sample Messages

Consent request:

LegacyCloud: [Sender Name] is asking you to record a short audio or video memory for them. Reply YES to receive the secure recording link. Reply STOP to opt out, HELP for help. Msg freq varies. Msg & data rates may apply.

Link delivery (sent only after YES):

LegacyCloud: Thanks! Here is your secure link to record a memory for [Sender Name]: https://thelegacycloud.com/r/[token]. Link expires in 7 days. Reply STOP to opt out, HELP for help.

4. Message Frequency

Message frequency varies and is driven by user activity. A typical Recipient receives one to two messages per request. A Recipient receives messages only when a Sender initiates a request involving the Recipient's number. There is no marketing, promotional, or recurring messaging through the LegacyCloud SMS program.

5. Costs

Message and data rates may apply, depending on the Recipient's mobile carrier and plan. LegacyCloud does not charge Recipients to receive messages.

6. Opt-Out (STOP)

Recipients may reply STOP to any LegacyCloud message at any time to unsubscribe. After replying STOP, the Recipient will receive a final confirmation message and no further LegacyCloud SMS will be sent to that number. Opt-outs are persistent across future Sender requests until the Recipient reinitiates contact.

7. Help (HELP)

Recipients may reply HELP to any LegacyCloud message to receive support information. The HELP auto-response will identify LegacyCloud and Hustle Machine LLC, point to this SMS Terms page, and provide support contact information.

For support questions, email support@thelegacycloud.com.

8. Supported Carriers

LegacyCloud SMS is supported on major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages.

9. Privacy

We do not sell, rent, share, or otherwise transfer mobile phone numbers collected for SMS purposes, or SMS consent itself, to third parties for marketing or promotional purposes. Numbers are processed solely to deliver the recording requests described above and are retained in accordance with our Privacy Policy.

10. Eligibility

Recipients must be at least 13 years old. Senders are responsible for ensuring that any Recipient phone number they enter belongs to an individual age 13 or older (or such higher age as applicable local law requires).

11. Changes

We may update these SMS Terms from time to time. We will post the updated version at https://thelegacycloud.com/sms-terms and update the "Last updated" date above.
